Terms of Service
Effective date: June 2, 2026
Please read these terms carefully. Sections 13 (Arbitration) and 14 (Class Waiver) require disputes to be resolved by binding individual arbitration in Maricopa County, Arizona, and waive your right to a jury trial or class action, except as expressly stated.
These Terms of Service ("Terms") are a binding agreement between you ("you" or "Customer") and NotaryBolt, Inc., a Delaware corporation with its principal place of business at 2390 E Camelback Rd, Suite 130, Phoenix, AZ 85016 ("NotaryBolt," "we," "us," or "our"). By creating an account, booking a notary, preparing a document, or otherwise using our website, applications, or services (collectively, the "Services"), you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.
1. Eligibility and accounts
You must be at least 18 years old and legally able to enter into contracts. You agree to provide accurate, current, and complete information when creating an account and to keep your credentials confidential. You are responsible for all activity that occurs under your account.
2. What NotaryBolt is, and is not
NotaryBolt is a technology platform that (a) helps you prepare draft documents from information you provide, and (b) coordinates appointments with independent, third-party notaries public commissioned under Arizona law (A.R.S. Title 41, Chapter 2, Article 3) or the laws of other jurisdictions where the notary is commissioned. NotaryBolt is not a law firm, is not a substitute for an attorney, and does not provide legal advice, opinions, recommendations, or representation. Communications with NotaryBolt are not protected by attorney-client privilege. If you need legal advice you should consult a licensed attorney in your jurisdiction.
Notaries who accept bookings through the Services are independent contractors, not employees or agents of NotaryBolt. NotaryBolt does not control, supervise, or guarantee the work of any notary. A notarial act is governed by the law of the state in which it is performed.
3. Document preparation
Documents generated through the wizard are drafts based on the information you supply. You are solely responsible for the accuracy and completeness of your inputs and for confirming that any document meets your needs and the requirements of the relevant jurisdiction, court, or third party. NotaryBolt does not review documents for legal sufficiency.
4. Booking, fees, and payment
Booking fees are displayed before checkout and consist of a base service fee, optional travel and printing fees, and the per-signature notarial fee. Arizona law caps notarial fees at $10.00 per notarial act (A.R.S. § 41-316). All other amounts represent service, travel, and platform fees and are not notarial fees. Payments are processed by Stripe; by paying you authorize the charge and any applicable taxes.
NotaryBolt charges a platform fee equal to twenty percent (20%) of the booking subtotal, with the remainder paid to the notary after the appointment is completed.
5. Cancellations and refunds
You may cancel a booking from your dashboard. Refunds are determined by the time between cancellation and the scheduled appointment:
- More than 24 hours in advance: 100% refund.
- 2 to 24 hours in advance: 50% refund.
- Less than 2 hours in advance, or no-show: no refund.
If a notary fails to appear or refuses to perform the appointment for reasons not caused by the customer, you will receive a 100% refund. Refunds are issued through Stripe to the original payment method and typically settle within 5–10 business days.
6. Your obligations at the appointment
You agree to:
- Present valid, government-issued photo identification that satisfies A.R.S. § 41-311(8) or the equivalent law of the state where the act is performed;
- Sign the document in the notary's presence (or via approved remote technology where permitted);
- Provide accurate information about yourself and any other signers;
- Provide a safe, lawful location for the appointment; and
- Not request that the notary perform a notarial act the notary is not authorized to perform, including acts on the notary's own behalf or where the notary has a conflict of interest.
7. Notary terms (applies to notaries)
If you accept bookings as a notary, you represent and warrant that:
- You hold a current, valid commission as a notary public in the state where you will perform the act;
- You maintain any required errors-and-omissions insurance and surety bond;
- You will comply with all applicable notarial laws, including Arizona's notary statutes and the Notary Public Reference Manual;
- You will maintain a notarial journal for the period required by law (A.R.S. § 41-319);
- You will not solicit customers off-platform during the term of your engagement; and
- You are an independent contractor solely responsible for your own taxes, expenses, and the lawfulness of each notarial act you perform.
8. Acceptable use
You will not, and will not allow any third party to:
- Use the Services for any unlawful purpose, including fraud, forgery, or identity theft;
- Upload or transmit malware or content that infringes intellectual property or privacy rights;
- Reverse engineer, scrape, or interfere with the Services;
- Misrepresent your identity, authority, or relationship to any document or person;
- Use the Services to evade legal process or to harass any person.
We may suspend or terminate accounts that violate these Terms, with or without notice, and may report unlawful activity to appropriate authorities.
9. Intellectual property
NotaryBolt and our licensors own all right, title, and interest in the Services, including all software, content, templates, trademarks, and trade dress. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for your personal or internal business purposes. You retain ownership of the documents and content you create or upload, and you grant NotaryBolt a limited license to host, process, transmit, and display such content solely as necessary to provide the Services.
10. Disclaimers
THE SERVICES AND ALL CONTENT, INCLUDING ANY DOCUMENT GENERATED THROUGH THE WIZARD, ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. NOTARYBOLT EXPRESSLY DISCLAIMS ALL WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. NOTARYBOLT DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DOCUMENT WILL BE ACCEPTED BY ANY COURT, AGENCY, OR THIRD PARTY.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NOTARYBOLT AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, BUSINESS, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF NOTARYBOLT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTARYBOLT'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO NOTARYBOLT IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
Some jurisdictions do not allow certain limitations of liability; in those jurisdictions our liability is limited to the maximum extent permitted by law.
12. Indemnification
You will defend, indemnify, and hold harmless NotaryBolt and its officers, directors, employees, contractors, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your use of the Services, (b) your breach of these Terms or any law, (c) your documents or other content, or (d) your acts or omissions during any notarization.
13. Governing law, venue, and arbitration
These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws principles, and by applicable U.S. federal law including the Federal Arbitration Act, 9 U.S.C. §§ 1 et seq.
Binding arbitration. Except for the carve-outs below, any dispute, claim, or controversy arising out of or relating to these Terms or the Services will be resolved by final and binding individual arbitration administered by JAMS in accordance with its Streamlined Arbitration Rules and Procedures, before a single arbitrator. The seat and venue of arbitration will be Maricopa County, Arizona. The arbitrator may award the same remedies a court could, but only on an individual basis. Judgment on the award may be entered in any court of competent jurisdiction.
Carve-outs. Either party may (a) bring a claim in small-claims court in Maricopa County, Arizona, if the claim qualifies, or (b) seek injunctive or other equitable relief in the state or federal courts located in Maricopa County, Arizona, for actual or threatened infringement of intellectual property or misuse of confidential information.
Opt-out. You may opt out of this arbitration agreement by sending written notice to legal@notarybolt.com within thirty (30) days after first accepting these Terms.
14. Class-action waiver and jury-trial waiver
YOU AND NOTARYBOLT AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE OR JOIN CLAIMS OF MULTIPLE PERSONS. IF A COURT FINDS THIS CLASS-ACTION WAIVER UNENFORCEABLE, THE PARTIES' DISPUTE WILL BE DECIDED BY A COURT IN MARICOPA COUNTY, ARIZONA, AND BOTH PARTIES WAIVE ANY RIGHT TO A JURY TRIAL TO THE FULLEST EXTENT PERMITTED BY LAW.
15. Termination
You may stop using the Services at any time and may close your account by contacting support. We may suspend or terminate your access to the Services at any time, with or without notice, if we believe you have violated these Terms, created risk for NotaryBolt or other users, or if we discontinue the Services. Sections 2, 3, 9, 10, 11, 12, 13, 14, and 16–18 survive termination.
16. Changes to the Services or these Terms
We may modify the Services or these Terms from time to time. If we make material changes to these Terms, we will notify you by email or through the Services and update the effective date above. Changes take effect when posted. Your continued use of the Services after the changes take effect constitutes acceptance.
17. Notices
Notices to NotaryBolt must be sent to legal@notarybolt.com with a copy by mail to NotaryBolt, Inc., Attn: Legal, 2390 E Camelback Rd, Suite 130, Phoenix, AZ 85016, USA. Notices to you may be sent to the email address associated with your account and are deemed given on the date sent.
18. Miscellaneous
These Terms, together with the Privacy Policy and any order confirmations, are the entire agreement between you and NotaryBolt regarding the Services and supersede all prior agreements. If any provision is held unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right is not a waiver. You may not assign these Terms without our prior written consent; we may assign them freely. There are no third-party beneficiaries.
